CASAS FOR KIDS PLAYHOUSE RAFFLE TERMS & CONDITIONS

Thank you so much for your support of CASA of Sedgwick County.  Your purchase of one or more of WPWB’s (WABA’s Professional Women in Building) CASAS for Kids raffle ticket(s) signifies your agreement to the following Terms & Conditions. In the event of any dispute, a reasonable interpretation or determination by CASA and WABA (Wichita Area Builders Association) as to the application of these Terms & Conditions is final and binding. This CASAS for Kids raffle is void where prohibited by law. This raffle is open only to residents of the state of Kansas.

Eligibility
To be eligible to purchase a ticket, you must be at least 18 years old and a living resident of the United States and residing in the State of Kansas.

A ticket purchased by an ineligible person is void and cannot be a winning ticket. No refunds will be made to ineligible purchasers. A ticket issued in exchange for a check returned for “insufficient funds,” or for a credit card charge that was “declined,” or reported as “invalid” or “stolen” is void and cannot be a winning ticket.

The determinations of CASA and WABA are final and binding with respect to any matter arising out of the interpretation or application of these terms and conditions and raffle eligibility.

Tickets

A ticket represents a chance to win the opportunity to accept an offer of the stated playhouse as a prize. All sales of tickets are final, and no refunds will be paid. Raffle tickets will be sold at $20 each or three (3) tickets for $50 or seven (7) tickets for $100. Purchaser must select the individual playhouse they wish to win for each ticket they purchase before they can complete their transaction and be entered to win the selected playhouse.

Tickets, prizes, receipts, and any winner’s rights are not transferable.

The IRS has ruled that a payment for a raffle ticket is a tax-deductible charitable contribution only to the extent the amount of the payment exceeds the price of the ticket.

Ticket sales for the CASAS for Kids Playhouse Raffle will begin at 12:01 am CDT on October 1, 2021 and end at 3:00 pm CDT on February 6, 2022.

Tickets will be sold exclusively on-line as digital raffle tickets only at www.CASASforKidsKS.org.

The Drawing

The winning ticket for each of the six (6) individual playhouse prizes will be selected by a random drawing. All tickets have an equal chance to win the playhouse(s) they selected when they entered. Ticket purchasers need not be present to win. No minimum or maximum number of tickets to be sold has been established.  Chances of winning a prize are dependent on the number of tickets sold for each playhouse.

Winners and Prizes
The final selection of the Six (6) separate winning tickets for the playhouse prizes will be conducted by CASA of Sedgwick County in conjunction with Wichita Area Builders Association in a random drawing.

If a winning ticket has more than one name on it, the prize will be awarded to the eligible individual whose name appears first on the ticket. That individual is solely responsible for allocating the value of the prize among the purchasers.
 

CASA/WABA will officially notify the six (6) separate playhouse prize winners via a phone call.  The winner must accept the prize, “as is,” by signing the Winner Affidavit (“WA”) and returning it to WABA within 10 days after the drawing.  If the winner fails to accept the prize, the prize is forfeited and no substitute or alternative prize will be provided. A forfeited prize will be awarded to a newly drawn winner out of the existing raffle entrants for that specific playhouse prize.

Acceptance of a prize constitutes permission for CASAS for Kids/CASA of Sedgwick County/WABA or any  media partners or any other affiliated sponsor to use the winner’s name, picture, video image, and relevant quotes to promote CASAS for Kids raffles and programs, and agreement by the winner that the prize will not be used for fundraising for another charity.

CASA/WABA may, at its sole option, substitute a prize of equal or greater value if the stated prize is not reasonably available. The agreed upon fair market value of the prize will be provided on the WA.   

The winner of each prize shall have no rights in or to the prize itself until he/she has timely executed the WA and returned it to CASA/WABA and until delivery of the prize to the winner has been completed. Until that time, as between CASA/WABA and the winner, each prize remains the sole property of CASA. Delivery arrangements must be made within 30 days of the prize drawing.  Free delivery within a 30-mile radius of Wichita to each winner’s driveway only is included.  Delivery outside of the 30-mile radius will require special arrangements and mileage costs will be incurred.  A Vendor List of companies with the expertise to “install” each playhouse beyond the driveway delivery will be provided with the WA and all costs associated with this will be the Winner’s responsibility.  The winner accepting the prize or the substituted prize will take ownership subject to all applicable federal, state, and local restrictions.

Taxes

The value of each prize is includible in the winner’s gross income, and is subject to reporting by CASA to the Internal Revenue Service. Each winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of his or her acceptance of the prize.

The winner of any prize is fully liable for any and all taxes, fees, or other costs associated with prize winnings.

Winners should consult a tax professional. All Playhouse prizes are valued at more than the $600 value required to report to the IRS and, therefore, will be reported and appropriate tax forms will be issued to the winner. 

No Warranty
Each winner accepts the prize “as is,” and without recourse to CASA of Sedgwick County, Wichita Area Builders Association, or any Sponsor affiliated with the CASAS for Kids raffle with respect to any defect, injury, damage, or other problem that may arise or become apparent with respect to the prize.

Limitation of Liability
Because CASAS For Kids and all affiliated organizations and/or sponsors has no right to control, nor exercises any control, over the personnel of any seller, or manufacturer of any prize, or any part of any prize CASAS For Kids and all affiliated organizations and/or sponsors assumes no responsibility for any financial loss, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity that a winner may experience by reason of (1) performance or nonperformance by any supplier; (2) wrongful, careless, negligent, or unauthorized acts or omissions by any supplier or its employees, or by any other party not under the control of CASA; (3) acts of God and acts or omissions of third parties; (4) mechanical or construction failures; or any other event or condition beyond CASA’s control. Each winner hereby releases and holds CASA of Sedgwick County, Wichita Area Builders Association, KWCH TV, Summit Media, or any Sponsor affiliated with CASAS for Kids raffle harmless with respect to any claim based on any such occurrence.

CASA of Sedgwick County, Wichita Area Builders Association, KWCH TV, Summit Media, or any Sponsor affiliated with CASAS for Kids raffle shall in no event be liable for special or consequential damages arising from the use or ownership of any prizes.
